Plain-language terms for using AgentMetal. Short on purpose; we'll expand them as the service leaves preview. Using AgentMetal means you accept what's below.
1Who we are
AgentMetal is operated by E-NGENIUM INFRAESTRUCTURA, S. de R.L. de C.V. (trading as "iNBest Cloud"), Av. Unión #163, Piso 1, Col. Lafayette, C.P. 44140, Guadalajara, Jalisco, México. In these terms "we" / "us" means that company and "you" means the person or agent using the service. Questions and abuse reports: [email protected].
AgentMetal is in early preview. Features, prices, and these terms may change; the service is provided as-is (see §7).
2What we sell
Prepaid Linux virtual machines (VPS), billed per day — 1 to 30 days per payment — or monthly if you register an account. You get root access; what you run on the machine, and its legality, is your responsibility (§4). You're responsible for securing your own server and your own keys.
3Payment & refunds
- Pay with USDC on Base (x402) or a credit/debit card. Prices are in US dollars and exclude any taxes that may apply.
- Running servers are non-refundable. This is stated in the payment request (the HTTP 402 response) before you pay, every time.
- If provisioning fails, crypto authorizations simply expire (you are never charged); card payments are retried across locations until your server is created, and refunded only if we ultimately cannot provision it. You never keep a charge without a server.
- Card payments are processed by Stripe; crypto settles on-chain through a payment facilitator. We don't store card numbers or private keys.
4Acceptable use
You may not use AgentMetal, and may not let anyone use a machine you control, to:
- Break the law — Mexican law or the law that applies to you or your users; this includes child sexual abuse material, fraud, and distributing malware or stolen data.
- Mine, farm, or plot cryptocurrency, or run staking / validator / blockchain nodes. Our upstream infrastructure providers prohibit this; we have to pass that rule through.
- Launch or assist denial-of-service (DoS/DDoS) attacks, port scanning, intrusion attempts, or any other network abuse.
- Send spam or unsolicited bulk messaging. (Outbound SMTP / port 25 is blocked by default.)
- Operate botnets, command-and-control, phishing, or credential-harvesting infrastructure.
- Use the service if you are subject to applicable sanctions, or to evade them.
5Fair use & enforcement
Default quotas (active servers per payer, provisioning rate) keep the platform healthy; registered accounts get higher defaults. When something looks abusive we may ask for verification (an email, a card), suspend a machine (powered off, data preserved, where practical), and for repeat or serious abuse terminate and blocklist. We act on credible abuse reports from upstreams and third parties. We aim to notify you, but may act first when harm is ongoing.
6Expiry & your data
Servers are prepaid. After expiry a machine keeps running for a 24-hour grace period, then is permanently destroyed along with its data. Back up anything you need before then — backups are your responsibility. We don't keep destroyed-server data.
7Service "as is"; liability
The service is provided as is, without warranties, and without a uptime SLA during preview. To the extent the law allows, our total liability to you for any claim is limited to what you paid us in the 30 days before the claim. Nothing here limits liability that can't be limited under Mexican law, including your rights as a consumer under the Ley Federal de Protección al Consumidor.
8Privacy
We collect the minimum to run the service: an email only if you register an account, payment records, and operational logs (including the IPs and activity needed to handle abuse). Payments are handled by Stripe and the x402 facilitator; wallet addresses are public on-chain by nature. The responsable for personal data is iNBest Cloud; how we handle it and how you exercise your ARCO rights is described in our aviso de privacidad.
9Governing law
These terms are governed by the federal law of México. Any dispute is subject to the courts of Guadalajara, Jalisco, without prejudice to any mandatory consumer-protection rights you have where you live.
10Changes
We may update these terms; the version and effective date at the top will change. Continuing to use the service — including renewing a server — after an update means you accept the new terms.
